In furthering this commitment, it is critical that BMC Helix’s intellectual property assets be protected, and that its copyrights, trade secrets, trademarks, patents, proprietary algorithms, AI-developed works, and license agreements be enforced. BMC Helix respects the intellectual property of others and asks our partners, end-users, and third parties to do the same with BMC Helix products and the intellectual property embodied in them.

BMC Helix will take all necessary steps to protect our intellectual property rights and aggressively pursue those who violate BMC Helix’s intellectual property rights. In that regard, BMC Helix considers the following activities, among others, to be unacceptable violations of our intellectual property rights:

• Piracy: Software piracy includes unauthorized use, replication or distribution of BMC Helix technology, among other things.
• License Non-Compliance: Non-compliance with software license agreements may include using more capacity than licensed for the BMC Helix technology, among other things.
• Theft & Misappropriation: The unauthorized access, use, or distribution of BMC Helix’s intellectual property may constitute a crime, which may carry severe criminal and civil penalties.
• Open-Source Misuse: Unauthorized use of BMC Helix software in violation of applicable open source license terms, or misrepresentation of BMC Helix proprietary code as open source, is strictly prohibited.
• AI & Emerging Technology Violations: Unauthorized use of BMC Helix’s AI-driven tools, models, or algorithmically generated outputs including reproduction, reverse engineering, or derivative exploitation is a violation of its intellectual property rights.

Users of pirated or unauthorized software also expose themselves and their organizations to significant risk, including system instability, security vulnerabilities, software corruption, and lack of technical support.

In order to preserve the integrity of our products, it is important that suspected incidents of software piracy, license non-compliance, and other abuses or violations of BMC Helix’s intellectual property be brought to BMC Helix’s attention.
